Licence Booking Notice
Casual room bookings made through Pennington Terrace are granted by way of temporary licence only, not lease or tenancy, and are intended to create permission for short-term room use only. Nothing in these booking arrangements is intended to create exclusive possession or a retail or commercial lease relationship.
Practitioners with recurring or ongoing use may be required to enter a separate written Room Licence Agreement.
Eligibility and Professional Requirements
All room bookings are limited to professionals in the fields of psychotherapy, psychology, social work, counselling, or allied health.
The following conditions must be met before using our rooms:
• Valid Public Liability Insurance and Professional Indemnity Insurance covering the duration of the room usage.
• Full compliance with all South Australian health regulations, privacy laws, and professional codes of conduct.
The Mirson Trust reserves the right to refuse or cancel bookings from professionals who do not meet these requirements.
The Mirson Trust is not registered for GST. Fees published for room bookings are not subject to GST.
TERMS AND CONDITIONS AT ROOM BOOKING
1. Acceptance of Terms
By making a booking, paying a deposit or fee, or using the premises, the practitioner (“Licensee”) agrees to be bound by these Terms and Conditions.
Acceptance of these Terms constitutes a licence agreement between the Licensee and The Mirson Trust (“Licensor”).
2. Nature of Booking — Licence Only
All room bookings are granted by way of licence only, not lease or tenancy.
A booking grants temporary permission to use the booked consulting room and shared amenities during the booked period, subject to these Terms.
No exclusive possession, ongoing tenancy, or property right is created.
3. Booking and Payment
Bookings are confirmed only upon receipt of payment.
Fees are as published at the time of booking.
Bookings are personal to the practitioner who made the booking and are not transferable without consent.
4. Cancellations and Refunds

Cancellations more than 48 hours prior: refund or credit available

Payment is made online. The $25 deposit included and non-refundable, except under the following specific circumstances:

Cancellation by The Mirson Trust due to room unavailability or unforeseen issues.

Cancellation due to emergencies (medical, professional or family) at our discretion.

Cancellations within 48 hours: booking fee may be forfeited

Non-attendance: no refund
5. Professional Use
Rooms may be used only for lawful professional purposes consistent with counselling, psychotherapy, allied health, consulting, or approved professional practice.
The premises must not be used for unlawful, disruptive, unsafe, or inappropriate purposes.
6. Practitioner Requirements
By booking, the practitioner warrants that they:

hold required registrations or qualifications for their practice (where applicable);

maintain appropriate professional indemnity insurance;

maintain public liability insurance if required;

comply with applicable laws, ethical codes, privacy obligations, and professional standards.
The Licensor may request evidence of insurance or credentials.
7. Privacy and Confidentiality
Practitioners are responsible for maintaining client privacy and confidentiality while using the premises.
This includes responsibility for:

managing confidential conversations appropriately;

securing client records;
-
maintaining privacy in shared spaces.
8. Use of Premises
The practitioner agrees to:

leave rooms in good order;
-
report damage or incidents;
-
comply with access, security and exit procedures;

use shared facilities reasonably.
The practitioner is responsible for damage caused beyond fair wear and tear.
9. Limitation of Liability
To the extent permitted by law, the Licensor is not liable for loss, damage, interruption, theft, or business disruption arising from use of the premises, except where liability cannot lawfully be excluded.
10. Indemnity
The practitioner indemnifies the Licensor against claims arising from the practitioner’s conduct, use of the premises, or breach of these Terms, except to the extent caused by the Licensor’s negligence or breach of law.
11. Right to Refuse or Cancel Bookings
The Licensor may refuse, suspend, or cancel bookings where reasonably necessary for safety, compliance, misuse, or breach of these Terms.
12. Separate Written Licence Agreements
For recurring, ongoing or regular room use, the Licensor may require a separate written Room Licence Agreement.
13. Governing Law
These Terms are governed by the laws of South Australia.

Room Use Conditions
• Rooms & Kitchenette must be left clean and tidy after use.
• Report any damage immediately; additional fees may apply.
• Practitioners are responsible for client confidentiality and must manage sessions to avoid overlap or disruption.
• No subletting or transferring of bookings without prior written consent.
